Die deeltitelformaat word algemeen gebruik vir die ontwikkeling van aftree-oorde in welke geval die Wet op Deeltitels sowel as die Wet op Behuisingskemas vir Afgetrede Persone van toepassing is.<\/p>\n<b>Wat is deeltitel?<\/b><br \/>\nA sectional title development scheme (usually referred to as a scheme) provides for separate ownership of parts of a property by individuals. These schemes are governed by the Sectional Titles Act, No. 95 of 1986. Residing in a sectional title scheme is a commitment to form part of a community that is bound by rules and the Sectional Titles Act. How do you establish a sectional title ownership and what exactly does one own?\nThe deeds registry includes a list of all the sections in the scheme, and specifies the name and details of each owner. You will buy a section, plus an undivided share of the common property. Taken together, this property is called your unit.<br \/>\n\n<p><b>'n Eenheid strek tot: <\/b><\/p>\n<ul>\n<li>die middelpunt van buite- of skeidingsmure;<\/li>\n<li>die onderste deel van die plafon; en<\/li>\n<li>boonste gedeelte van die vloer.<\/li>\n<\/ul>\n<b>Wat is gemeenskaplike eiendom?<\/b><br \/>\nDie gemeenskaplike eiendom is daardie deel van 'n ontwikkeling wat nie deel vorm van enige afdeling nie. Strukture en areas in hierdie kategorie sluit in:\n<ul>\n<li>Oprit<\/li>\n<li>Tuin<\/li>\n<li>Swembad<\/li>\n<li>Korridors<\/li>\n<li>Hysbak<\/li>\n<li>Ingangsportaal<\/li>\n<li>Parkeerplek<\/li>\n<li>Buitemure<\/li>\n<li>Fondasie<\/li>\n<li>Roof<\/li>\n<\/ul>\n<b>Wat is die regspersoon?<\/b><br \/>\nEach scheme has a body corporate. It is an association, not a company or a partnership &#8211; with the ability to contract, sue and be sued. All unit owners are members. The function of the body corporate is to administrate and manage the common property. The body corporate makes decisions on two levels:\n<ul>\n<li>op vergaderings van eienaars<\/li>\n<li>op vergaderings van trustees<\/li>\n<\/ul>\n<p><b>Wie beheer die regspersoon?<\/b><\/p>\n<p>Alle eienaars van eenhede is lede van die regspersoon. Hulle verkies trustees wat beheer voer oor die daaglikse bestuur van die skema. Trustees stel dikwels 'n bestuursagent aan om hulle by te staan.<\/p>\n<p>Die Trustees is verplig om die skema te bestuur in ooreenstemming met die voorskrifte van die Deeltitelwet, die Wet op Behuisingskemas vir Afgetrede Persone en die skema se re\u00ebls en enige beperking of opdrag waartoe die eienaars op 'n algemene jaarvergadering besluit (Grondwet).<\/p>\n<p>Trustees word op elke jaarvergadering van die eienaars verkies. As eienaar is jy geregtig om jou as trustee beskikbaar te stel, maar dit is nie verpligtend nie. Die trustees hoef nie almal eienaars te wees nie, en hulle word gewoonlik nie vir hul dienste betaal nie.<\/p>\n<p>Die raad van Trustees by Caves Aftree-Oord bestaan uit 5 lede en \u2019n Oordbestuurder. Huidiglik verteenwoordig drie van die trustees die eienaars van die Oord en twee trustees verteenwoordig die ontwikkelingsmaatskappy. Sodra die Oord klaar ontwikkel is, onttrek die ontwikkelaars en neem die eienaarsvereniging volle beheer van die bestuur van die Oord.<\/p>\n<p>The Act defines a &#8220;retired person&#8221; as a fifty year old or older. A younger person may own a property, but it may only be occupied if either he\/she or his\/her spouse are older than 50. The property may be leased to a person older than the age of 50.<\/p>\n<p><b>Hoe veilig is \u2019n belegging in \u2019n aftree-oord?<\/b><\/p>\n<p>Persone wat in aftree-oorde bel\u00ea, het 'n behoefte aan die beskerming van hul belegging, die beveiliging van hul okkupasiereg en inspraak in die beheer en bestuur van die oord. Die Wet op Behuisingskemas vir Afgetrede Persone, nr. 65 van 1988, bied sekere beskermings- maatre\u00ebls aan kopers van eenhede of woonregte in aftree-oorde. Die doel van die wet is derhalwe die beskerming van bejaardes teen uitbuiting deur ontwikkelaars.<\/p>\n<p>Vir 'n voornemende belegger is dit belangrik om vas te stel welke verbande oor die projek geregistreer is. Die lede van s\u00f3 'n skema het voorkeurregte bo enige verbandhouer, maar die betalingsvermo\u00eb van die ontwikkelaar het steeds 'n invloed op die harmonie van die skema h\u00ea. Dit is ook van belang dat voornemende beleggers moet vasstel of die beloofde gemeenskaplike geriewe (bv. 'n siekeboeg) reeds voltooi is en, indien nie, wanneer dit voltooi sal word.<\/p>\n<p>Die belegger moet vasstel of die skema deur 'n regspersoon in terme van die Wet op Deeltitel of 'n bestuursvereniging in terme van die Wet op Behuisingsontwikkelingskemas bestuur word.<\/p>\n<p>Bogenoemde beginsels is die riglyne waarvolgens die Caves Aftree-Oord funksioneer. Die projekbestuurspan was reeds betrokke by twee ander aftree-oorde en beskik oor heelwat ondervinding en kennis wat tot voordeel van die nuwe Oord aangewend word. Daar is geen ontwikkelings-verbande oor Caves Aftree-Oord nie.<\/p>\n<p><b>Mag ek my eenheid verhuur?<\/b><\/p>\n<p>Ja, jy mag jou eenheid verhuur. Die Huurders word onderwerp aan dieselfde gedragsre\u00ebls en grondwet as eienaars van die eenhede. Die eienaar bly steeds regsaanspreeklik vir alle koste aangegaan.  Die eienaar het die opsie om sy Siekeboeg voordele aan die huurder te sedeer vir die tydperk van die huurkontrak mits die huurder jonger as 65 jaar is. Hierdie re\u00ebling bly egter onderhewig aan die goedkeuring van die Raad van Trustees.<\/p>\n<p><b>Wat is die begiftigingsheffing?<\/b><\/p>\n<p>By die herverkoop van \u2019n eenheid, word 10% van die herverkoopprys aan Caves Aftree-oord betaal vir die heffingstabiliseringsfonds. Hierdie fonds, wat deur die Raad van Trustees namens die eienaars-vereniging bestuur word, sal gebruik word om heffings te subsidieer en bydra tot die bestuur van die oord en enige noodsaaklike herstelwerk.
